Agreement to Terms

By accessing or using Designova Studio's website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of These Terms of Service ("Terms") govern your use of the Designova® Studio websites.

Our Services

Designova Studio provides design and development services including but not limited to:

  • Web design and development
  • UI/UX design
  • Brand identity design
  • Digital product design
  • Consulting services

User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

Intellectual Property Rights

Our Content

The website and its original content, features, and functionality are owned by Designova Studio and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Client Work

Upon full payment, clients receive ownership rights to deliverables as specified in individual project agreements. Designova Studio retains the right to showcase completed work in our portfolio unless otherwise agreed.

Payment and Billing

Payment terms are specified in individual project agreements. Generally:

  • Invoices are due within 14 days of issuance unless otherwise specified
  • Late payments may incur interest charges
  • Work may be paused for overdue invoices
  • All fees are non-refundable unless otherwise stated

Project Timelines

Project timelines are estimates and may be subject to change based on project scope, client feedback timing, and unforeseen circumstances. We will communicate any timeline changes promptly.

Revisions and Changes

The number of revision rounds is specified in individual project agreements. Additional revisions beyond the agreed scope may incur additional fees. Significant scope changes will require a new project agreement.

Confidentiality

We respect the confidentiality of client information and projects. We will not disclose confidential information to third parties without client consent, except as required by law or as necessary to complete the project.

Termination

Either party may terminate a project agreement with written notice. In the event of termination:

  • Client is responsible for payment for work completed to date
  • Designova Studio will deliver all completed work
  • Any deposits or advance payments are non-refundable
  • Intellectual property rights transfer only for paid work

Warranties and Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner. However:

  • Services are provided "as is" without warranties of any kind
  • We do not guarantee specific results or outcomes
  • We are not responsible for third-party services or platforms
  • Client is responsible for content accuracy and legality

Limitation of Liability

To the maximum extent permitted by law, Designova Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services. Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.

Indemnification

You agree to indemnify and hold Designova Studio harmless from any claims, damages, losses, liabilities, and expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes may be resolved through mediation or arbitration before resorting to litigation.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.
